TERMS AND CONDITIONS
Agreement Purpose:
This Agreement defines the terms
between MILLENNIALS MARKETING Limited and yourself. It governs your use of the MILLENNIALS
MARKETING Platform and access to Services.
MILLENNIALS MARKETING Identification:
MILLENNIALS MARKETING Limited is
a registered company in England (Company Number: 9368082) with an address at 7
Bell Yard, London WC2A 2JR, UK. It's referred to as "MILLENNIALS MARKETING,""we,"
or "our."
Defined Terms Explanation:
Additional Subscription Period(s): Duration to extend subscription beyond Minimum
Term, aligning with Minimum Term length.
Affiliates: Entities
linked by control, either directly, indirectly, or through common control.
Company Website: Site promoting your services, possibly licensed by MILLENNIALS
MARKETING as part of Paid For Services.
Data Protection Laws: EU regulations governing personal data use,
including EU Regulation 2016/679 and national laws.
Domain Name: Potentially
offered domain name as part of Services.
Intellectual Property Rights: Rights like patents, copyrights, trademarks,
registered/unregistered, protecting intellectual property.
Leads: Third-party
inquiries due to Services, regardless of communication channel or purchase
outcome.
Minimum Term: Agreed
minimum service duration, detailed in Order Summary.
Subscription Period(s):
Monthly service provision after Minimum Term,
commencing day after Minimum Term's end.
Order Summary: Emailed summary outlining package, cost, Start Date,
Minimum Term.
Other Digital Accounts: Managed accounts like Google My Business,
Facebook for Business, part of Services.
Services: MILLENNIALS
MARKETING-provided offerings, including website building, hosting, content,
Domain Name, Other Digital Account support.
Referral Credit: Credit for recommending third-party users of Services.
Service Provider: Third-party promoting products/services on MILLENNIALS
MARKETING Platform.
Setup Fee: One-time
new customer fee for MILLENNIALS MARKETING website construction.
Start Date: Service
initiation date, in line with Order Summary.
MILLENNIALS MARKETING Platform: MILLENNIALS MARKETING's tech platform,
including managed websites, applications, and possible Company Website.
User Data: Personal
data from MILLENNIALS MARKETING Platform users, per Data Protection Act 1998
definition.
SERVICES
MILLENNIALS
MARKETING provides access to Services as specified in the Order Summary under
this Agreement.
Payment
starts from Start Date for the Minimum Term at the rate in Order Summary.
Annual plans
renew, and domain name renewal charges apply in the 11th month.
Refunds
limited unless Services not provided as per Agreement.
Services
automatically renew after Minimum Term; notice to terminate required.
Cancellation
or downgrade at Minimum Term end or before current Additional Subscription
Period.
Services or upgrades available; existing domain transfer possible.
Price
adjustments possible with 1-month notice after Minimum Term.
LICENSE
License
granted to MILLENNIALS MARKETING and affiliates to use uploaded content.
Management
license for Other Digital Accounts.
Company Website
and/or Domain Name license for paying customers.
User data
management governed by Privacy Policy.
WARRANTIES
Warranties:
legal age, security, proper use, accuracy of content, lawful use, compliance
with terms, representation rights.
INDEMNITY
Indemnify MILLENNIALS
MARKETING for claims arising from use or breach.
DISCLAIMER
MILLENNIALS
MARKETING not liable for certain aspects; no guarantee on leads quality or
quantity.
CAP ON LIABILITY
Limitation
on MILLENNIALS MARKETING's liability; certain losses excluded.
BOOKING SERVICES & CUSTOM MESSAGES
Booking
services process; direct agreement with Service Providers; terms and conditions
apply.
DATA PROTECTION
User Data
management governed by Privacy Policy; MILLENNIALS MARKETING ownership with
usage rights.
TERMINATION
Termination
rights; notice periods and conditions apply.
Immediate
termination possible for policy violations or unsupported products/services.
Termination
consequences on rights and licenses explained.
Domain Name
transfer options and Other Digital Account management on termination.
MISCELLANEOUS
Agreement
revision and notification; Agreement precedence over Order Summary.
Confidentiality
of terms; address inquiries to MILLENNIALS MARKETING.
Unforeseeable
condition clause; MILLENNIALS MARKETING not liable for certain disruptions.
Disclaimer
on third-party sites; use at own risk.
Access and
management of Other Digital Accounts; separate agreements apply.
REFUND POLICY
Refund
policy for new customers; questionnaire completion required for website
creation.
Refund
eligibility within 30 days; questionnaire completion not relevant to refund.
Website
delivery delay extends Refund Period; refund covers amount paid except for
custom domain.
ENGLISH LAW & JURISDICTION
Agreement
governed by English law and under jurisdiction of England and Wales courts.
